1. Agreement to Terms
By accessing or using VibeScribe ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
These Terms apply to all visitors, users, and others who access or use the Service, including users of the VibeScribe desktop application and any associated web services.
2. Description of Service
VibeScribe is a voice-to-text transcription application for macOS that uses artificial intelligence to convert spoken audio into written text. The Service includes:
- Real-time voice transcription using industry-leading speech recognition technology
- AI-powered text refinement and formatting
- Local transcription history storage
- Cloud-based processing for transcription and refinement
3. User Accounts
3.1 Registration
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 Account Security
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Subscription Plans and Payment
4.1 Free Tier
The free tier provides limited access to the Service with a weekly word limit of 2,000 words. This limit resets each week.
4.2 Paid Plans
We offer paid subscription plans ("Pro" and "Developer") that provide additional features and unlimited transcription. Subscription fees are billed in advance on a monthly or annual basis.
4.3 Refunds
All paid plans include a 7-day money-back guarantee. If you are not satisfied with the Service, you may request a full refund within 7 days of your initial purchase. Refund requests should be sent to hello@vibescribe.me.
4.4 Plan Changes
You may upgrade or downgrade your subscription plan at any time. Plan changes take effect at the start of your next billing cycle. No pro-rated refunds are provided for downgrades.
5. Fair Use Policy
Important: To ensure service quality and prevent abuse, all accounts are subject to our Fair Use Policy.
The Service is intended for personal productivity and professional use. The following limitations apply:
- Recording Limits: Maximum of 10 hours of recording time per calendar month per account
- Concurrent Sessions: The Service may only be used on one device at a time per account
- Automated Use: Automated or programmatic access to the Service is prohibited without prior written consent
Accounts that exceed fair use limits may be subject to temporary throttling, suspension, or termination. We reserve the right to modify fair use limits with reasonable notice.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe the intellectual property rights of others
- Transmit harmful, threatening, abusive, or otherwise objectionable content
- Attempt to gain unauthorized access to the Service or its related systems
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any aspect of the Service
- Use the Service to transcribe audio you do not have the right to record or use
- Resell, redistribute, or sublicense access to the Service
7. Intellectual Property
7.1 Our Rights
The Service and its original content, features, and functionality are owned by VibeScribe and are protected by international copyright, trademark, and other intellectual property laws.
7.2 Your Content
You retain ownership of any audio you record and text you generate using the Service ("Your Content"). By using the Service, you grant us a limited license to process Your Content solely for the purpose of providing the Service.
8. Privacy and Data
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in our Privacy Policy.
9. Third-Party Services
The Service integrates with third-party services for transcription processing (Deepgram) and AI refinement (OpenAI). Your use of these features is subject to the respective third-party terms and privacy policies. These services are SOC 2 and GDPR compliant and do not retain your audio data after processing.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that transcriptions will be 100% accurate.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBESCRIBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of these Terms and, where appropriate, providing additional notice (such as via email).
Your continued use of the Service after any changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
